Safeguarding - PVG and Safer Recruitment

Safe recruitment is an essential part of our safer sport practice which demonstrates our commitment to ensuring those who are recruited into paid or unpaid roles, are suitable to work with children, young people and adults at risk. It is, therefore, important that all reasonable steps are taken to ensure unsuitable individuals are prevented from working with children, young people and adults at risk.

Protecting Vulnerable Groups (PVGs) check an individuals’ suitability to work with children, young people and adults at risk. A PVG scheme application must be carried out for every individual carrying out regulated work within a regulated role in a club. Even if the individual has a PVG with another organisation (for example, with work), they still require an active PVG for the regulated role they are undertaking in a basketball club. The role cannot be commenced until the PVG is in place and the PVG will now only last for 5-years, after which, a new PVG will need to be applied for.

Disclosure Scotland maintains lists of individuals barred from regulated work with children and young people, and adults at risk. Volunteer Scotland Disclosure Service (VSDS) supports organisations to access the PVG scheme.

By law, harmful behaviour must be reported even if it takes place outside of the club, or the club only finds out about it after the employee or volunteer has left.

A referral must be made if basketballscotland or an affiliated club takes the following action because an individual within the club / sport has harmed a child or young person, or placed them at risk of harm:

  • Permanently dismisses or removes an individual from regulated activity / work
  • Would have dismissed an individual if they had not resigned/retired
  • Moves an individual to another role within the club / organisation which is not regulated work.

This referral must be made within 3-months of the action being taken and applies even if the harmful behaviour occurred outwith basketball.

basketballscotland and clubs have a legal responsibility to make a referral in the above circumstances. For guidance on the grounds and process for making a referral, contact the basketballscotland Safeguarding Lead.
